Handling of personal data

In the following, we would like to inform you about our handling of personal data when using this website. Unless otherwise described in the following sections, the legal basis for a handling of your personal data results from the necessity of a handling for the provision of the functionalities requested by you on this website (Art. 6 (1)(b) General Data Protection Regulation (GDPR)).

Use of the website

1. Calling up the website

When you call up our website, your browser transmits certain data to our web server for technical reasons in order to provide you with the information you have called up. To enable you to visit the website, the following data is collected, stored for a short time and used:

  • IP address
  • Date and time of the request, time zone difference to Greenwich Mean Time (GMT) 
  • Content of the request (specific page)
  • Operating system and its access status / HTTP status code
  • Amount of data transferred
  • Website from which the request comes
  • Browser, language and version of the browser software.

In addition, to protect our legitimate interests, we store this data for a limited time in order to initiate a derivation to personal data in the event of unauthorized access or attempted access to local servers (Art. 6(1)(f) GDPR).

2. Newsletter and processing for advertising purposes

You have the option to register for one of our newsletters. If you register for our newsletter, we are entitled to use your e-mail address for the purpose of sending you up-to-date information about our company, products and services, offers and news. The registration for our newsletter takes place in a so- called double opt-in procedure. The legal basis for the data processing is Art. 6 (1)(a) GDPR (your consent). You can unsubscribe from the newsletter at any time by clicking on the respective link at the end of the newsletter or object to the processing of your personal data. In doing so, please use the contact details below. If you object or unsubscribe from our newsletter service, the respective data will be blocked or deleted and no longer processed for such purposes.

The newsletter is sent using "MailChimp", a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The E-Mail addresses of our newsletter recipients, as well as their other data described in the context of this notice, are stored on MailChimp's servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to address them itself or to pass them on to third parties. You can find MailChimp's privacy policy here.

If you are already a customer of ours, your E-Mail address may be used to contact you with information about modility’s own products and similar products. The legal basis for said processing is Art. 6 (1)(f) GDPR. The processing of customer data for the purpose of our own direct marketing is considered to be processing serving a legitimate interest. According to Art. 21 (2) and (3) GDPR, you also have the right to object to this processing at any time. 3. Use of cookies

a) What are cookies

On this website we use so-called "cookies". Cookies are small text files that are stored in the memory of your terminal device via your browser. Cookies store certain information (e.g. your preferred language or page settings), which can be sent back to us by your browser when you visit the website again (depending on the lifetime of the cookie).

b) How you prevent the use of cookies

You can configure the use of cookies in the settings of your browser at any time or disable them completely. However, this may lead to restrictions in the functions or user-friendliness of our offer.

4. Optimization of the internet presence and the website

We also use cookies and tracking software on our website to determine the frequency of use and the number of users on our website. With this software, we do not collect individual personal data or individual IP addresses. The data is used exclusively in anonymized and aggregated form for statistical purposes and for the development of the website. a) Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States.

IP anonymization We have activated the IP anonymization function on this website. This means that your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google. b) Hotjar

We use Hotjar to better understand the needs of our users and to optimize the offering and experience on this website. Using Hotjar's technology, we get a better understanding of our users' experiences (e.g., how much time users spend on which pages, which links they click, what they like and dislike, etc.) and this helps us tailor our offerings to our users' feedback. Hotjar works with cookies and other technologies to collect data about our users' behavior and about their devices, in particular IP address of the device (collected and stored only in anonymized form during your website use), screen size, device type (Unique Device Identifiers), information about the browser used, location (country only), language preferred to view our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually prohibited from selling the data collected on our behalf. c) Google Tag Manager

Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus, for example, integrate Google Analytics as well as other Google marketing services into our online offering). The Tag Manager itself (which implements the tags) does not process any personal data of the users. 5. External services and content on our website

We include external services or content on our website. When you use such a service or when third- party content is displayed to you, communication data is exchanged between you and the respective provider for technical reasons. In addition, the provider of the respective services or content may process your data for further, own purposes. We have configured services or content from providers known to process data for their own purposes to the best of our knowledge and belief so that either communication for purposes other than displaying the content or services on our website does not take place, or communication only takes place when you actively decide to use the service. However, since we have no influence on the data collected by third parties and its processing by them, we cannot provide any binding information on the purpose and scope of the processing of your data. 6. Transfer of data for processing on our behalf

Processing of data outside the EU / EEA is only provided for if an adequate level of data protection is guaranteed pursuant to Art. 44 et seq. GDRP is provided for.

KPS AG for modility GmbH takes all necessary technical and organizational security measures to comprehensively protect your personal data. Your data is stored in a secure operating environment that is not accessible to the public. In certain cases, your personal data is encrypted during transmission using so-called Secure Socket Layer technology (SSL). This means that communication between your computer and the servers of KPS AG for modility GmbH takes place using a recognized encryption method if your browser supports SSL.
